SAN FRANCISCO, Calif. - August 15 -- Anant Tripati states that as a result of filing judicial misconduct complaints against Judges on the Federal Appeals Court in San Francisco (Federal Judge Roslyn Silver of Phoenix, No. 04-89067; 04-89011) and as he in a book "THE ROGUE FEDERAL JUDGE" (ISBN: 14185141X, AuthorHouse) exposed the fact that the federal judge allegedly paid back political favors to her friends in deciding a case, Tripati claims the Ninth Circuit is not reviewing the record in appeals he has filed as retaliation.
February 24th, 2004 Judges William Fletcher, Ferdinand Fernandez, Richard Tallman stated in an order they were denying Tripati's permission to appeal the denial of his federal habeas corpus and they stated they were relying on a December 3rd, 2003 document filed (93-80317). There was no December 3rd, 2003 filing. Had the judges reviewed the record they would have found this, says Tripati.
March 30th, 2005 Judges Betty Fletcher, Stephen Trott, Richard Paez entered an order stating that after reviewing the record they determined they had no jurisdiction. However, they did not have any record before them to review because the record was with the Justice Department (93-80317).
Tripati has - through his lawyer Fred Romero - filed appeal 04-17148. He believes the Ninth Circuit will do what it has previously done and not review the record. According to Tripati: "If they review the record they will have to reverse and remand the case for a jury trial and this will prove I have been right about the court."
With supporting documents and affidavits, Tripati shows he is serving 52.5 years in prison for "fraudulent schemes" which were allegedly manufactured by Arizona authorities with the help of three judges in Phoenix (www.corruptarizonacourts.com). Now he states that because of the Ninth Circuit not reviewing the record, he has to remain in prison until 2044, though innocent.
Tripati states, "Every day we hear about judges acting inappropriately. These judges should not cover for one another, but be above reproach and held accountable."
